AEROTEST OPERATIONS, INC., NOTICE OF CONSIDERATION OF APPROVAL OF APPLICATION REGARDING PROPOSED INDIRECT TRANSFER AND CONFORMING AMENDMENTS, OPPORTUNITY FOR A HEARING, AND ORDER IMPOSING PROCEDURES FOR ACCESS TO SENSITIVE UNCLASSIFIED NON-SAFEGUARDS INFORMATION

Dear Mr. Nellis and Dr. Slaughter:

Enclosed is a copy of a notice of Consideration of Approval of Indirect License Transfer and Conforming Amendment related to the application dated May 30, 2012, filed by Aerotest Operations, Inc., and Nuclear Labyrinth LLC. Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.80, Transfer of licenses, the application seeks U.S. Nuclear Regulatory Commission approval of the proposed indirect transfer of the Aerotest Radiography and Research Reactor (ARRR), Facility Operating License No. R-98, currently held by Aerotest Operations, Inc., a subsidiary of OEA Aerospace, Inc. The notice is for consideration of approval of your application regarding the proposed indirect license transfer of the ARRR and conforming amendment, provides opportunity for a hearing, and includes an order imposing procedures for access to sensitive unclassified non-safeguards information.

The transfer would involve a change in the ownership of Aerotest Operations, Inc., from OEA Aerospace, Inc., to Nuclear Labyrinth LLC, but the licensee for the ARRR, Aerotest Operations, Inc., would not change. The application also seeks, pursuant to 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit, the issuance of conforming amendments to the license to reflect the transfer.
