Supplemental Notification Pursuant to 40 C.F.R. Part 266, Subpart N; VHWMR § 7-109(b)(2)
Dear Mr. Simoes:
This letter supplements our letter to the Agency dated March 23, 2016. In that letter, consistent with Subpart N of 40 C.F.R. Part 266, as incorporated into the State of Vermont's Resource Conservation and Recovery Act program pursuant to VHWMR § 7-109(b)(2) (collectively, the "Mixed Waste Rule"), Entergy Nuclear Vermont Yankee, LLC ("ENVY") claimed the conditional exemption for on-site storage and treatment of low level mixed waste that may be generated by or is otherwise associated with the planned disassembly and demolition of the building commonly known as the North Warehouse at the Vermont Yankee Nuclear Power Station in Vernon, Vermont. In a letter dated May 5, 2016, the Agency acknowledged that our March 23 letter satisfied the informational requirements for the storage and treatment exemption outlined in 40 C.F.R. § 266.230(a).
Subsequent to our March 23 letter, we received the re;Sults of additional laboratory analyses, which indicated the presence of chromium, in addition to lead and *silver. Accordingly, ENVY hereby updates the information provided on March 23 by including the waste code D007 as an "Expected Waste Code."
