Michael M. Gibson, Chairman Dr. Michael F. Kennedy Dr. William W. Sager In the Matter of Docket Nos. 50-250-LA and 50-251-LA FLORIDA POWER & LIGHT COMPANY ASLBP No. 15-935-02-LA-BD01 (Turkey Point Nuclear Generating, Units 3 and 4) January 4, 2016 ORDER (Admitting Exhibits)
The Board held a prehearing conference call on Monday, January 4, 2016, to discuss administrative matters in advance of the evidentiary hearing for this proceeding that will commence on January 11 in Homestead, Florida.1 In accordance with 10 C.F.R. § 2.337, the Board has determined the following exhibits are sufficiently reliable, material, and relevant to the proceeding, and so admits:
- Florida Power and Light exhibits, FPL-001 through FPL-031, including all subparts, FPL-032R, and FPL-033 through FLP-036, as well as FPL-037 (a December 31, 2015 administrative order from the Florida Department of Environmental Protection, that is to be filed by Florida Power and Light today, shortly after the issuance of this Order).
- Citizens Allied for Safe Energy exhibits, INT-000 through INT-006, INT-012, INT-013, 1 See Atomic Safety and Licensing Board; In the Matter of Florida Power & Light Company (Turkey Point Nuclear Generating, Units 3 and 4), 80 Fed. Reg. 76324 (Dec. 8, 2015).
INT-029, INT-030, INT-042, INT-043, and INT-076.2 The Board will not admit INT-009, INT-014, INT-015, INT-033, INT-034, INT-035, INT-045, and INT-048 because they are duplicative of other exhibits that have been admitted.3 The Board will not admit INT-039 because it is irrelevant. The Board will rule on whether to admit INT-017 and INT-028 no later than the commencement of the evidentiary hearing on Monday, January 11, 2016.
Any objections to the exhibits that were offered but were not admitted, as well as any objections to the admission of exhibits INT-000, INT-001, INT-017, INT-028, and INT-076, must be made in writing and filed no later than January 6, 2016.
Any proposed cross-examination questions related to FPL-037 must be submitted to the Board in camera no later than January 6, 2016.
