UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Michael M. Gibson, Chairman Dr. Michael F. Kennedy Dr. William W. Sager In the Matter of Docket Nos. 50-250-LA and 50-251-LA FLORIDA POWER & LIGHT COMPANY ASLBP No. 15-935-02-LA-BD01 (Turkey Point Nuclear Generating, Units 3 and 4) November 19, 2015 ORDER (Granting in Part Extension for Summary Disposition Motions)

Florida Power & Light Company (FPL) has moved the Board to extend the deadline for motions for summary disposition to December 4, 2015, in order to provide FPL with time to review the rebuttal evidence that will be submitted by Citizens Allied for Safe Energy, Inc.

(CASE) on December 1, 2015.1 CASE and the NRC Staff do not oppose FPLs motion.2 The Board grants the extension of time in part. The Board finds good cause to set the deadline for motions for summary disposition after the deadline for CASEs rebuttal evidence.

However, setting December 4 as the deadline would not provide the Board sufficient time to consider any such motions before its own deadline for ruling on summary disposition. In order to rule on pending motions for summary disposition at least fifteen days before the hearing 1 Florida Power & Light Companys Unopposed Motion for Extension of Time to File Motions for Summary Disposition (Nov. 17, 2015) [hereinafter FPLs Motion for Extension]. For a hearing beginning on January 11, 2016, the deadline for such motions would normally be November 27, 2015. 10 C.F.R. § 2.1205(a).

2 FPLs Motion for Extension at 2.

begins on January 11, 2016, the Board will need to issue such an order no later than Thursday, December 24, 2015.3 Accordingly, the Board extends the following deadlines: motions for summary disposition are now due no later than Thursday, December 3, 2015, and answers to motions for summary disposition are now due no later than Wednesday, December 23, 2015.4 It is so ORDERED.
