Dear Administrative Judges:
On October 19 and 20, the State filed New York States Motion for the Public Disclosure of Various Westinghouse Documents, together with a supporting Declaration of Assistant Attorney General Lisa S. Kwong and a number of attachments. The State filed public redacted, and non-public non-redacted versions of the States Motion and of some of these supporting documents via the NRCs Electronic Information Exchange.
It has come to the States attention that the numbering of certain attachments in the Kwong Declaration was incorrect, and that one attachment, which is cited in the States Motion and which was filed as part of the States submission, was inadvertently not listed in the Kwong Declaration.
As summarized below, the State hereby submits corrected copies of both the public (redacted) and non-public (non-redacted) versions of New York States Motion for the Public Disclosure of Various Westinghouse Documents, a corrected copy of the Declaration of Lisa S.
Kwong, and replacement copies of two attachments to the Kwong Declaration.
- 1. New York States Motion for Public Disclosure of Various Westinghouse Documents (public and non-public versions)
In the non-public version, all pages are revised to include notice that the document Contains Westinghouse Designated Proprietary Information; THE CAPITOL, ALBANY, N.Y. 12224-0341 PHONE (518) 776-2400 FAX (518) 650-9363 WWW.AG.NY.GOV
At page 3, fn. 3, Attachments 3-12 to the Kwong Declaration is replaced with Attachments 2-11 to the Kwong Declaration; and At page 4, fn. 7, (Kwong Decl., Att. 2) is replaced with (Kwong Decl., Att. 12).
- 2. Declaration of Lisa S. Kwong The formatting of existing Paragraph Nos. 10-21 is corrected to remove a space in the word Attached; Paragraph No. 17 is replaced with a declaration as to new Attachment 16 which was inadvertently not included in the existing Kwong Declaration, as follows: Attached to this declaration as Attachment 16 is a true and correct copy of letter from Kathryn M. Sutton and Paul M. Bessette to Administrative Judges Lawrence G. McDade, Dr.
Michael F. Kennedy and Dr. Richard E. Wardwell; Re: Entergy Nuclear Operations, Inc., (Indian Point Nuclear Generating Units 2 and 3), Docket Nos. 50-247-LR and 50-286-LR - Redacted Filings for Track 2 Contentions; Sent: September 18, 2015.;
Existing Paragraph Nos. 17-22 are renumbered Nos. 18-23 to accommodate the new Paragraph No. 17; The Attachment Nos. corresponding to existing Paragraph Nos. 17-22 (i.e., new Paragraph Nos. 18-23) are renumbered to correspond correctly to Attachments 17-21; and Existing Paragraph No. 19 (i.e., new Paragraph No. 20) is revised to insert a space after the reference to NYS000513, and to correct the name of author Kupper.
- 3. Attachment No. 8 to the Declaration of Lisa S. Kwong Corrected public and non-public versions of Attachment No. 8 are submitted with revised coversheets to reference WCAP-17162-P, Revision 1, which is included as part of NYS000363, and which was inadvertently not referenced in the coversheet that accompanies Attachment No. 8 as originally filed.
- 4. Attachment No. 21 to the Declaration of Lisa S. Kwong A corrected public version of Attachment No. 21 is submitted to include a coversheet to identify Attachment No. 21, and to provide notice of copyrighted material contained in that attachment.
