Asforthetenremainingdocumentsandaswediscussedduringourrecentcall,theyareverysimilartothefour WestinghouseCalcNotesdiscussedintheBoardsJuly20decisionthatconcludedsuchdocumentscontainconfidential commercialinformationwhichisentitledtoprotectionunder10C.F.R.§2.390(a)(4).Infact,twoofthetenaremerely revisedversionsofthedocumentsatissueinthatearlierdecision.Moregenerally,alltendocumentsareWestinghouse fatiguecalculationsorreportsatypeofdocumentthatismaintainedinconfidencebyWestinghouseandcontains informationwhich,ifreleased,likelywouldleadtosubstantialcompetitiveharmtothecompany,forallofthereasons explainedinEntergysandWestinghousesfilingsbeforetheBoardandCommissionrelatedtotheStatesApril9th motion.Therefore,itisWestinghousesandEntergyspositionthattheyareproprietaryandshouldremainsubjectto thetermsoftheProtectiveOrder.
Entergyremainsopentofurtherdiscussionsandcooperationamongthepartiesregardingtheconductoftheupcoming Track2hearing,soastomaximizepublicinvolvementtotheextentpracticable,giventheproprietarynatureofthe documentslistedintheStatesNoticeandotherproprietaryexhibitsintheTrack2hearingrecord.
