UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Michael M. Gibson, Chairman Dr. Michael F. Kennedy Dr. William W. Sager In the Matter of Docket Nos. 50-250-LA and 50-251-LA FLORIDA POWER & LIGHT COMPANY ASLBP No. 15-935-02-LA-BD01 (Turkey Point Nuclear Generating, Units 3 and 4) October 19, 2015 ORDER (Granting Request for Extension of Time)

On October 15, 2015, the NRC Staff filed an unopposed motion requesting an eleven day extension of time to file their written testimony, exhibits, and statement of position.1 The NRC Staff assert that the extension is necessary because Citizens Allied for Safe Energy, Inc.

(CASE) was delayed in submitting attachments that exceeded the file size limit for the NRC email system.2 In the same motion, Florida Power & Light (FPL) also requests the same eleven day extension for the sake of efficiency and uniformity.3 For good cause shown, the motion is granted. Moreover, in light of the difficulties that CASE has encountered with the NRC email and electronic filing system, the Board will also accept as timely any initial statements of position and written testimony (including exhibits and attachments) filed by October 20, 2015. The NRC Staffs and FPLs written testimony, exhibits, 1 NRC Staffs Unopposed Motion for an Extension of Time for the Filing of Testimony, Exhibits, and Statement of Position (Oct. 15, 2015).

2 Id. at 1-2.

3 Id. at 4. CASE, the intervenor in this license amendment proceeding, is amenable to a common date being established for both the Staffs and FPLs filings. Id.

and statements of position are now due no later than November 10, 2015. Accordingly, all other subsequent filing deadlines will be shifted forward by eleven days, as shown on this chart:

Event Date Initial Statement of Position and Written October 20, 2015 Testimony from CASE Initial Statements of Position and Written November 10, 2015 Testimony from NRC Staff and FPL CASEs Rebuttal Statement of Position December 1, 2015 and Written Testimony Motion in Limine/Motions to Strike December 15, 2015 Proposed Questions to the Board December 22, 2015 Motions for Cross-Examination December 22, 2015 However, consistent with the Initial Scheduling Order,4 the above extension will not change the Boards plan to hold an evidentiary hearing during the week of January 11, 2016. No other extensions will be granted absent good cause shown.

It is so ORDERED.
