December 1, 2015 OFFICE OF NUCLEAR REACTOR REGULATION NOTIFICATION OF SIGNIFICANT LICENSING ACTION LICENSEE: Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc.

SUBJECT:

PROPOSED ISSUANCE OF A FINAL NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION AND LICENSE AMENDMENT FOR WHICH A HEARING HAS BEEN REQUESTED This is to inform the Commission that a final no significant hazards consideration determination and license amendment will be issued on or about December 18, 2015, to Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (the licensee). This action is being taken in response to the licensees amendment application dated June 12, 2014,1 as supplemented by additional letters,2 and will modify Renewed Facility Operating License No. DPR-28 for the Vermont Yankee Nuclear Power Station. Specifically, the license amendment will revise the site emergency plan and emergency action level scheme to reflect the reduced scope of offsite and onsite emergency planning and the significantly reduced spectrum of credible accidents that can occur for the permanently defueled condition.

A hearing on the license amendment was requested by the State of Vermont, through its Public Service Department, on February 9, 2015 (Hearing Request).3 On May 18, 2015, the Atomic Safety and Licensing Board Panel (ASLBP) presiding over the matter denied the hearing request.4 On June 12, 2015,5 the State of Vermont filed an appeal to the Commission regarding the ASLB order.
