U.S. NUCLEAR REGULATORY COMMISSION ACCESS TO THE SENECA NATION PROPERTY FOR THE PURPOSE OF INSPECTION OF LICENSEES SAMPLING ACTIVITIES ASSOCIATED WITH LICENSE CSF-1

Dear Mr. John,

On September 30, 2015, the U.S. Department of Energy (DOE) and New York State Energy Research and Development Authority (NYSERDA), a U.S. Nuclear Regulatory Commission (NRC) Licensee, met with the Seneca Nation Environmental Director, other members of the Seneca Nation, the U.S. Environmental Protection Agency, and the NRC to discuss, among other issues, DOEs and NYSERDAs 2014 Aerial Radiological Survey of the Western New York Nuclear Service Center Report (Report). The NRC attended this meeting and answered the Seneca Nations questions regarding the NRCs regulatory oversight role in the off-site sampling that NYSERDA plans to conduct.

At this meeting, the NRC explained that it performed a preliminary screening dose assessment of off-site areas identified in the Report as having above background radiation levels on Cattaraugus Territory of the Seneca Nation of Indians. Importantly, the NRC concludes that these levels do not pose a threat to public health and safety. Furthermore, NYSERDA plans to conduct additional soil sampling and analyses in order to characterize these off-site areas, to undertake a land use survey, and to perform a public dose assessment. The results of these studies will be submitted to the NRC. The NRC will evaluate NYSERDAs results to verify that there is no threat to public health and safety.

As part of its oversight role of Title 10 of the Code of Federal Regulations (10 CFR) Part 50 activities, the NRC can inspect NYSERDAs off-site sampling activities. NYSERDA requested approval to enter the Cattaraugus Territory of the Seneca Nation to conduct sampling, by a letter to you dated October 6, 2015. The NRC respectfully requests approval to enter the Cattaraugus Territory of the Seneca Nation of Indians for the purpose of inspecting NYSERDAs sampling activities on the Cattaraugus Territory of the Seneca Nation of Indians.

The NRC designates Mr. Raymond Powell as the NRC Liaison to coordinate efforts with the Seneca Nation on approval to enter the Cattaraugus Territory to inspect NYSERDAs sampling activities. The NRC inspection staff will provide at least 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> advance notice of the NRC

staffs plans to enter the Cattaraugus Territory of the Seneca Nation of Indians. All NRC personnel will display official NRC identification badges at all times while on the Cattaraugus Territory of the Seneca Nation of Indians.

The NRC encourages the Seneca Nation to contact the NRC if the Seneca Nation has any questions regarding our inspection and review process, our inspection findings, and the results of our evaluation of NYSERDAs submittal.
