RESULTS OF PERIODIC REVIEW OF REGULATORY GUIDE 1.13 This memorandum documents the U.S. Nuclear Regulatory Commission (NRC) periodic review of Regulatory Guide (RG) 1.13, Spent Fuel Storage Facility Design Basis, published in March 2007. This RG endorses the American National Standards Institute/American Nuclear Society standard N210-1976/ANS-57.2-1983. As discussed in Management Directive 6.6, Regulatory Guides, the NRC staff reviews RGs approximately every five years to ensure that the RGs continue to provide useful guidance. The documentation of the Office of Nuclear Reactor Regulation (NRR) staff review is enclosed.
Based on the results of the periodic review, the NRR staff concludes that no changes to RG 1.13 are warranted at this time.

- 1. What are the known technical or regulatory issues with the current version of the Regulatory Guide (RG)?
Regulatory Guide 1.13, Spent Fuel Storage Facility Design Basis, published in March 2007, endorses the American National Standards Institute/American Nuclear Society standard N210-1976/ANS-57.2-1983. In the staffs initial periodic review of RG 1.13 performed in October 2013, the staff identified a potential need to include guidance for performance of criticality reviews in order to meet General Design Criteria (GDC) 61 and GDC 62 with exceptions. However, the staff is currently reviewing Nuclear Energy Institute (NEI) 12-16, Guidance for Performing Criticality Analyses of Fuel Storage at Light-Water Reactor Power Plants. The staff plans to complete review of NEI 12-16 by September 2016. If NEI 12-16 is found acceptable, the staff plans to develop a new RG to endorse NEI 12-16. If the staff develops a new RG, the initial draft will be ready by July 2017.

There are currently no known or anticipated licensing or inspection activities from internal or external stakeholders that will be impacted by not updating RG 1.13 at this time.
