PETITION OF JOHN F. DOHERTY FOR ISSUANCE OF A SHOW CAUSE ORDER BASED ON IE INFORMATION NOTICE NO. 85-38 V' On June 11, 1985, John F. Doherty filed a Petition pursuant to 10 CFR 2.206 requesting issuance of an order under 10 CFR 2.202 to all Babcock and Wilcox facilities to show cause why the operating licenses for those facilities should not be suspended or revoked until the problem identified in IE Information Notice No. 85-38 is resolved by inspection and correction of the condition. The IE Notice concerned loose parts which had been found to obstruct certain control rod drive mechanisms at the the Davis-Besse facility. The Petitioner raises a number of concerns allegedly associ ated with a failure of all control rods to operate when called on to do so. Violations of General Design Criteria 26 and 29 are also alleged.
My staff will work with your staff to develop an appropriate response. En closed for your use are:
(1) A draft acknowledgement letter (2) A draft notice of receipt of the Petition under 10 CFR 2.206 for publication in the Federal Register; and (3)
The original Petition Should you determine, following review of this Petition, that additional information from the licensees regarding the subject matter of the Petition would be useful to you in the preparation of a Director's Decision, such additional information may be solicited from the licensees by utilizing 10 CFR 50.54(f) and section 182 of the Atomic Energy Act.
Please provide us with copies of all documents related to the Petition.
Also, please place our office on concurrence for all correspondence initiated by the staff and related to this Petition.

Your Petition requests issuance of an order under 10 CFR 2.202 to all Babcock and Wilcox facilities to show cause why the operating licenses for those facilities should not be suspended or revoked until the problem identified in IE Information Notice No. 85-38 is resolved. The IE Notice concerned loose parts which had been found to obstruct certain control rod drive mechanisms at the Davis-Besse facility of the Toledo Edison Co.
The Petition is being treated under 10 CFR 2.206 of the Commission's regulations and appropriate action will be taken in a reasonable time. A copy of the notice that is being filed for publication with the Office of the Federal Register is enclosed for your information.
