Dear Mr. Tarver,

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated July 9, 2015, in which you appealed the agencys June 29, 2015, response notifying you that we were unable to locate some of the records you requested in your June 18, 2015, Freedom of Information Act (FOIA) request (FOIA 2015-0354). Each of these documents is enclosed.

As stated in the agencys initial response to you, the response letters for FOIA requests: 2009-0156, 2009-0205, and 209-0153 have been purged in accordance with NUREG-0910, "NRC Comprehensive Records Disposition Schedule. Once agency records are purged, they are required to be purged from all agency systems, including the Agencywide Documents Access and Management System (ADAMS). No copies of the FOIA letters referenced in this letter were located in ADAMS. Therefore, I have denied your appeal.

This is the NRCs final decision concerning your appeal. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may obtain judicial review of this decision in a district court of the United States in the district in which you reside or have your principal place of business. You may also seek judicial review in the district in which the agencys records are situated or in the District of Columbia.

The 2007 FOIA amendments created the Office of Government Information Services (OGIS) to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation. If you are requesting access to your own records (which is considered a Privacy Act request), you should know that OGIS does not have the authority to handle requests made under the Privacy Act of 1974.
