Dear Mr. Tarver,

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated July 9, 2015, in which you appealed the agencys June 29, 2015, redactions made to the records related to your June 29, 2015, Freedom of Information Act (FOIA) request (FOIA/PA-2015-0353). Each of these documents is enclosed.

The NRC has re-evaluated the records and decided to grant your appeal, in part, by releasing information on the record that was previously withheld in full. The revised record is enclosed.

However, the NRC will continue to withhold the information pursuant to Exemption 6 of the FOIA (5 U.S.C. 552(b)(6)) and 10 CFR 9.17(a)(6) of the Commissions regulations, in all the other released records. Disclosure of information withheld pursuant to Exemption 6 would result in a clearly unwarranted invasion of personal privacy. I am unable to identify any legitimate public interest in the release of this information that outweighs the privacy interest of the individuals.

This is the NRCs final decision concerning your appeal. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you may obtain judicial review of this decision in a district court of the United States in the district in which you reside or have your principal place of business. You may also seek judicial review in the district in which the agencys records are situated or in the District of Columbia.

The 2007 FOIA amendments created the Office of Government Information Services (OGIS) to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation. Using OGIS services does not affect your right to pursue litigation. If you are requesting access to your own records (which is considered a Privacy Act request), you should know that OGIS does not have the authority to handle requests made under the Privacy Act of 1974.
