OF THE JUNE 9, 2015, PUBLIC MEETING WITH DAIRYLAND POWER COOPERATIVE AND ENERGYSOLUTIONS REGARDING THE PROPOSED TRANSFER OF THE LA CROSSE OPERATING LICENSE TO ENERGYSOLUTIONS TO ALLOW FOR ACCELERATED DECOMMISSIONING

Background

On June 9, 2015, a Category 1 public meeting was held between U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Dairyland Power Cooperative (DPC, the licensee) and EnergySolutions (ES) at NRC Headquarters, Two White Flint North, 11545 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss DPC and ESs plans and schedule regarding the future submittal of an operating license transfer application for the La Crosse Boiling Water Reactor (LACBWR).

The meeting notice dated May 28, 2015, can be found in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML15148A523. A list of attendees is provided in Enclosure 1.

Meeting On June 9, 2015, the NRC staff held a public meeting with DPC and ES to discuss the plans and schedule regarding the future submittal of an operating license transfer application for LACBWR that would allow ES to assume the majority of the remaining decommissioning responsibilities at the LACBWR facility. During the meeting, representatives from DPC and ES

gave a presentation on the proposed changes to the LACBWR decommissioning strategy and timeline given the license transfer. This presentation is provided as Enclosure 2 and can be found in ADAMS at Accession No. ML15189A169.

DPC stated that transferring the operating license to ES, which will create a new special purpose subsidiary called LaCrosseSolutions to manage the decommissioning activities at LACBWR, will allow for the remaining dismantlement and decontamination work at the site to be completed in a more efficient and timely manner, and will accelerate the overall timeline to complete decommissioning and terminate the LACBWR license. During the meeting, ES discussed the current LACBWR decommissioning process and remaining activities and how they will be streamlined, provided a summary of the significant changes being considered, and provided a schedule of upcoming milestones for both DCP and ES.

DPC and ES also discussed the potential benefits of transferring the LACBWR operating license to LaCrosseSolutions, which includes leveraging the technical experience of EnergySolutions in the fields of decommissioning and waste management and disposal, accelerating the overall decommissioning schedule for LACBWR, thereby reducing the radiological source term, and providing additional assurances beyond the LACBWR decommissioning trust fund that all decommissioning activities will be completed in a timely fashion The licensee stated that it plans to submit the application to transfer the LACBWR license to LaCrosseSolutions in July 2015, and that the License Termination Plan (LTP) will subsequently be submitted during the fourth quarter of calendar year 2015. The licensee further stated that they would like to be able to implement the license transfer and associated financial agreements by the end of calendar year 2015. The NRC staff stated that they will review the licensees application, the financial assurance mechanisms, and the technical qualification of LaCrosseSolutions to hold an operating license as expeditiously as possible, but could not guarantee that the review will be completed by the end of calendar year 2015.
