As discussed, I am currently reviewing a permit application from Exelon Generation for authorization, under Section 10 of the Rivers and Harbors Act, to conduct maintenance dredging near the facility's river water intake structure located in Kankakee River. As part of the permit review process, I need to ensure that the activity complies with Section 106 of the National Historic Preservation Act and Section 7 of the Endangered Species Act. Typically, this task is deferred to the Lead Agency, which, I believe in this case, would be NRC. Please let me know what you find out about your process is this situation and if you wish to obtain a copy of this application. Also, as discussed, please send me a copy of the DEIS.
