Dear Counselors:

In conformance with the Commissions policy on notification of potentially new, relevant, and material information, counsel for the U.S. Nuclear Regulatory Commission staff (Staff) hereby inform Southern Alliance for Clean Energy and Tennessee Valley Authority of the following:

Yesterday, May 4, 2015, the Staff provided to the Commission a paper (1) discussing the status of activities at Watts Bar Nuclear Plant (WBN) Unit 2 since the October 30, 2014, Commission meeting; and (2) requesting Commission approval for the Director of the Office of Nuclear Reactor Regulation (NRR) to issue a full-power operating license (OL), that is effective upon issuance, upon finding that the applicable regulatory requirements have been met.1 Through the request, the Staff is not asking to issue the license; the Staff is only asking for the authority to issue the license in the future consistent with its safety findings once those findings are complete. This request is now pending before the Commission and can be obtained through the Agencywide Documents Access and Management System via Accession No. ML15040A188.

In its Statement of Policy on Issuance of Uncontested Fuel Loading and Low Power Testing Operating Licenses, 46 Fed. Reg. 47,906 (Sept. 30, 1981), the Commission announced that in uncontested cases, fullpower operation will be authorized by the Commission, and the Director of NRR shall authorize fuel loading and low power testing without the need to obtain prior Commission approval.
