After conferring with the parties, the Board has determined that unless all of the Track 2 contentions1 are settled or otherwise resolved, we will proceed to a hearing on the Indian Point license renewal proceeding during the week of November 16, 2015.
Given the logistics of conducting the hearing in Tarrytown, this hearing date cannot be readily changed. If any witness is not available for questioning at the hearing, their written testimony is subject to being stricken from the record and thus unavailable for the proffering party to rely upon. Accordingly, counsel and witnesses must be available throughout the week of November 16, 2015.
1 Currently, Track 2 of the Indian Point evidentiary hearing includes Contentions NYS-25, NYS-26/RK-TC-1B, and NYS-38/RK-TC-5.
This hearing on the Track 2 Contentions will begin no earlier than 10 am on November 16, 2015, and conclude no later than 6 pm on November 20, 2015.
