ASLBP No. 07-858-03-LR-BD01 (Indian Point Nuclear Generating Units 2 and 3) March 31, 2015 ORDER (Requesting Information from All Participants)

In the event that contentions NYS-25, NYS-38/RK-TC-5, and NYS-26B/RK-TC-1B, are not resolved prior to hearing, the Board solicits the following information for planning purposes of an evidentiary hearing in Tarrytown, New York:

(1) The availability of each partys representatives and witnesses during the weeks of November 16 and 30. The Board anticipates that the hearing will be completed within one week, but asks for availability information for two weeks to allow for scheduling flexibility. Given the logistics of conducting the hearing in Tarrytown, once the dates for hearing are set, they cannot be readily changed. Accordingly, it is essential that witnesses for whom written testimony is presented be available on the days scheduled for the hearing because if a witness is not available for questioning at the hearing, their written testimony is subject to being struck. If a witness or necessary counsel will be unavailable at any time during these two weeks, state the dates and reasons for their unavailability.

(2) The intervenors in the above listed contentions are the State of New York and Riverkeeper. The Board requests that any other intervenor or interested government entities inform the Board that they intend to be present at the hearing.

(3) The number of representatives each party intends to have present at its table.

The Board requests that this information be received via the Electronic Hearing Docket no later than April 9, 2015.
