ORDER (Denying Motion to Stay the Proceeding)

The Vermont Department of Public Service, on behalf of the State of Vermont, moves for a stay in this proceeding while the Commission considers a Petition for Reconsideration related to the Commissions approval of certain exemptions from emergency planning requirements at the Vermont Yankee Nuclear Power Station.1 Because Vermonts attorney did not certify that he made a sincere effort to contact other parties in the proceeding and [to] resolve the issue(s) raised in the motion, as required by 10 C.F.R. § 2.323(b), the motion is denied. Vermont may refile its motion after making the required consultations.

It is so ORDERED.
