NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION

ISSUANCE OF NOTICE OF VIOLATION AND FINAL SIGNIFICANCE

DETERMINATION OF WHITE FINDING

This is to inform the Commission that a Notice of Violation (NOV) will be issued on or

about February 11, 2015, to Pacific Gas and Electric Company (the licensee), for a

Severity Level (SL) III violation associated with a White Significance Determination

Process finding. This White finding, an issue with low to moderate significance to safety,

will require additional NRC inspections. The finding involves a change to the emergency

plan which decreased the effectiveness of the emergency plan. Specifically, on

November 4, 2005, without approval from the NRC, the licensee removed instructions in

emergency plan implementing procedures for making protective action

recommendations for members of the public on the ocean within the 10-mile emergency

planning zone, decreasing the plans effectiveness. Using the examples in Table 5.10-1,

Significance Examples § 50.47(b)(10), of Appendix B to Inspection Manual Chapter 0609, "Emergency Preparedness Significance Determination Process," the inspectors

concluded that this finding represents a degradation of the licensees risk-significant

planning standard function.

A SLIII NOV is included based on the failure to meet the requirements of 10 CFR

50.54(q) by failing to apply and receive approval from the Commission for a proposed

change that decreased the effectiveness of the approved emergency plan.

The NRC issued a preliminary White finding to the licensee for this issue on

December 1, 2014. As a result, a Regulatory Conference was held on January 14,

2015, to discuss this issue. After considering the information developed during the

inspection and the additional information Diablo Canyon Power Plant staff provided at

the regulatory conference, the NRC has concluded that the violation is appropriately

characterized as Severity Level III, and that the associated finding is appropriately

characterized as White with low to moderate safety significance.
