Dear Mr. Heacock:
The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.
1-2014-005) on January 17, 2014, to determine whether an individual who was employed by a security contract company at Millstone was subjected to discrimination for raising security concerns. Based upon documentary and testimonial evidence developed during the OI investigation, there was insufficient evidence developed for the NRC to substantiate that the individual was discriminated against. However, the NRC is aware that this matter is still under review by the U.S. Department of Labor (DOL). As a result, we will maintain this file open pending review of any DOL decisions. We will inform you at a later date if our conclusion is altered.
Please note that final NRC investigation documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA once the allegation file is closed. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.
