CLOSURE OF INVESTIGATION (01 4-2013-045)

Dear Mr. Koehl :

This refers to an investigation conducted by the NRC's Office of Investigations regarding activities at South Texas Project Electric Generating Station. The Office of Investigations initiated the investigation to determine whether a contract nuclear security officer, working for G4S Regulated Security Solutions, at South Texas Project Electric Generating Station, VVadsworth, Texas, willfully provided security drill scenario information to another nuclear security officer.

Based on the evidence developed during the investigation, the allegation that a nuclear security officer at South Texas Project Electric Generating Station willfully provided security drill scenario information to another nuclear security officer was substantiated.

However, based on the evidence gathered during the investigation by the Office of Investigations and the Office of the General Counsel 's analysis of the investigation report, the NRC determined that the actions of the contract nuclear security officer do not constitute a violation of NRC requirements . Specifically, the investigation revealed that the contract nuclear security officer did not communicate information regarding the location or direction of the adversaries prior to the start of the drill. Although the contract nuclear security officer mistakenly communicated unearned directional information during the drill, this was not an unambiguous violation of South Texas Project Electric Generating Station procedures or NRC regulations . The NRC plans no further action related to the willful aspect of this allegation and considers this investigation closed .
