Dear Mr. Ventosa:

The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.

1-2014-004) on November 25, 2013, to determine whether an individual who was previously employed in the Security Department at the Indian Point Energy Center was subjected to discrimination by Entergy for raising safety and security concerns. Based on documentary and testimonial evidence gathered during the OI investigation, the NRC determined that there was insufficient evidence to conclude that the individual was subjected to discrimination for having raised nuclear safety and security concerns.

Please note that final NRC investigation documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.
