PRESIDENTIAL AND FEDERAL RECORDS ACT AMENDMENTS OF 2014 On November 26, 2014, President Obama signed into law the Presidential and Federal Records Act Amendments of 2014, with a provision that is particularly important for all U.S. Nuclear Regulatory Commission (NRC) employees.
This provision imposes a requirement on Federal employees when a non-official electronic messaging account (including a personal e-mail account) is used to conduct official business.
In the event an NRC employee creates or sends a Federal record using a non-official electronic messaging account, the employee must (1) copy their official NRC electronic messaging account on the original message or (2) forward a complete copy of the record to their official NRC electronic messaging account within 20 days after creating or sending the original message. For example, if an employee sends a Federal record using his or her personal e-mail account, the employee must include his or her official NRC e-mail account in the distribution of the message (e.g., as a cc) or forward the message to his or her official NRC e-mail account within 20 days after sending the original message.
As a reminder, electronic messages (including e-mails) can constitute Federal records if the messages are created as part of official business, contain evidence of agency activities that is appropriate for preservation, or are appropriate for preservation due to their informational value.
Consequently, agency employees are strongly encouraged not to use non-official electronic messaging accounts (including personal e-mail accounts) to conduct official business. In the rare case that an employee uses a non-official electronic messaging account to conduct official business, the employee must be mindful of the requirements in this provision. Violations of this provision may lead to disciplinary action.
