PROPOSED ISSUANCE OF A FINAL NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION AND LICENSE AMENDMENT FOR WHICH A HEARING HAS BEEN REQUESTED This is to inform the Commission that the U.S. Nuclear Regulatory Commission (NRC) staff intends to issue a final no significant hazards consideration determination and license amendment on or about February 4, 2015, to Entergy Nuclear Vermont Yankee, LLC, and Entergy Nuclear Operations, Inc. (the licensee). This action is being taken in response to the licensee's amendment application dated March 24, 2014, 1 as supplemented by letters dated May 21, 2014,2 and August 14, 2014,3 and will modify Renewed Facility Operating License No. DPR-28 for the Vermont Yankee Nuclear Power Station (VY). Specifically, the license amendment will revise the VY site emergency plan for the permanently defueled condition to reflect changes in the on-shift staffing and Emergency Response Organization staffing.

Thus, no adjudicatory proceeding is currently pending and the NRC staff is not required to provide the Commission with advance notice of the staff's intent to issue the license amendment. Nevertheless, given the circumstances, the staff determined that it would be prudent to notify the Commission that it intends to issue the license amendment in the next few days.
The State of Vermont will be notified of the issuance of this license amendment. In addition, the Office of General Counsel will notify the Atomic Safety and Licensing Board and the parties that the NRC staff intends to issue this license amendment and the associated final no significant hazards consideration determination DISTRIBUTION:
