Pursuant to 10 CFR 50.12, The Pennsylvania State University requests a specific exemption from the 90 day financial reporting time requirement of 10 CFR 50.75 (invoking by reference 10 CFR 30 App. E). Penn State requests that a 180 day period be accepted for the annual submittal of financial responsibility information to accommodate the external financial audit and approval processes of the University.
The requested exemption is permissible under 10 CFR 50.12 because it will not present a risk to the public health and safety and is consistent with the common defense and security and the 90 day requirement is not necessary to achieve the underlying purpose of the decommissioning funding rule.
The basis for a longer financial recertification time period was presented during the license renewal process (see ML0926550603) as the 90 day rule presents an undue hardship for Penn State. The requested exemption in no way reduces the effectiveness of the approved decommissioning plan.
Please exempt this request from fees per 10 CFR 170.1 l.a(4).
