NOTICE AND ORDER (Scheduling and Providing Instructions for Oral Argument)

Oral argument on contention admissibility will be held telephonically on Monday, December 1, 2014, beginning at 3:00 p.m. EST.1 The Board expects that argument will conclude by 5:00 p.m. EST. This order includes instructions concerning the format of oral argument and also identifies topics that counsel should be prepared to address.

The Board will hear argument in the following order: (1) the Vermont Department of Public Service (Vermont); (2) Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (Entergy); and (3) the NRC Staff. Vermont will have 60 minutes of argument 1

time. Entergy and the NRC Staff will each have 30 minutes of argument time. Vermont may reserve up to 15 minutes of its allotted time for rebuttal. No other rebuttal will be permitted.

The following list provides an overview of topics on which the Board intends to ask questions during oral argument. This list is not intended to be exclusive.

The Boards law clerk, Nicole Pepperl, will contact the parties with the dial-in number and passcode for the December 1, 2014, oral argument. Members of the public or media who wish to listen to the oral argument may do so, and should contact Ms. Pepperl at Nicole.Pepperl@nrc.gov for the listen-in number or with any questions.
