ORDER (Rescheduling Pre-Hearing Conference Call)

The Board originally scheduled a telephone conference call in this proceeding to be held on October 29, 2014, for the purpose of discussing pre-hearing matters, including the potential scheduling of oral argument on contention admissibility.1 That teleconference was cancelled,2 and will now be held on Thursday, November 6, 2014, at 2:00 PM EST.

This proceeding involves a request by Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. to amend its Site Emergency Plan to reflect reduced levels in the on-shift staffing and the Emergency Response Organization staffing at the Vermont Yankee 1

Nuclear Power Station, which is currently scheduled to cease operations by the end of 2014.3 The Vermont Department of Public Service, on behalf of the State of Vermont, opposes the request and contends that (1) the [Emergency Response Data System (ERDS)] link to the NRC

[must] be retained during Vermont Yankees permanently shut down and defueled period; or (2) an alternate means similar to ERDS [must] be made available to provide equivalent Radiation Monitoring System, Meteorological information, and Containment parameters relevant to the spent fuel pool conditions for as long as fuel remains within the spent fuel pool.4 The Boards law clerk, Nicole Pepperl, will contact the parties with the dial-in number and passcode for the November 6, 2014, conference call.
