LA CROSSE BOILING WATER REACTOR - REQUEST FOR U.S NUCLEAR REGULATORY COMMISSION APPROVAL OF REVISION 27 TO THE CROSSE BOILING WATER REACTOR QUALITY ASSURANCE PROGRAM DESCRIPTION (TAC NO. J53029)

Dear Mr. Berg:

By letter dated August 29, 2014, Dairyland Power Cooperative (the licensee) submitted a revision to the La Crosse Boiling Water Reactor (LACBWR) Quality Assurance Program Description (QAPD) for the U.S. Nuclear Regulatory Commission (NRC) review and approval pursuant with the requirements of an NRC Confirmatory Order dated September 15, 1994.

The LACBWR QAPD provides a consolidated overview of the quality program controls that govern the operation and maintenance of the LACBWR Independent Spent Fuel Storage Installation (ISFSI) and the decommissioning activities related to the LACBWR plant. The QAPD describes the quality assurance organizational structure, functional responsibilities, levels of authority and various interfaces.

The proposed changes would reflect the alteration in the status of the decommissioning site, in that the licensee has elected to suspend its LACBWR dismantlement activities, secure the plant in a safe and stable condition, and continue to negotiate for a contracted dismantlement agreement. The suspension of dismantlement will significantly reduce the overall staffing at LACBWR and result in a reorganization of the surrounding Genoa facility, which encompasses LACBWR and two collocated coal-generating and oil-generating power plants, respectively.

These changes require prior NRC review and approval in accordance with Section IV(a)(1) of the September 15, 1994, Confirmatory Order, which states, in part, that a reduction in site staffing levels below the minimum number for any group or area shown in the organization chart or a change in the reporting relationships for the Plant Manager must be submitted to the NRC as specified in 10 CFR 50.4, and receive NRC approval prior to implementation.

Specifically, the changes to the LACBWR QAPD reflect a LACBWR organization administered by a Site Manager, Genoa who has the overall responsibility for the site's nuclear safety and implementation of the QAPD. The Site Manager, Genoa reports directly to the Vice President, Generation, is the Chair of the Operations Review Committee, a member of the Safety Review Committee, and has signature responsibility for all procedures that implement the commitments and requirements of NRC-approved programs and plans. The routine work activities of the

W. Berg LACBWR ISFSI and Plant are organized and managed by a Plant / ISFSI Supervisor who reports directly to the Site Manager, Genoa. All other quality assurance responsibilities and the associated reporting chain remain unchanged.

The NRC staff has reviewed the proposed changes to the LACBWR QAPD and concluded that the associated revisions, as outlined in the letter referenced above, are considered acceptable because they continue to provide an organizational description that includes the organizational structure, functional responsibilities, levels of authority, and interfaces for establishing, executing, and verifying LACBWR quality assurance program implementation. In addition, the LACBWR QAPD: (1) establishes independence between the organization performing checking functions related to the quality assurance program and the organization responsible for performing the function; (2) provides for applicable management to be responsible to size the quality assurance organization commensurate with the duties and responsibilities assigned; and (3) clearly describes and defines responsibility and authority for planning, establishing, and implementing an effective overall quality assurance program.

In accordance with 10 CFR 2.390 of the NRCs Agency Rues of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
