RELAXATION OF CONFIRMATORY ORDERS This is to inform the Commission, that on or about September 29, 2014, Nuclear Material Safety and Safeguard (NMSS) will issue a relaxation of the Confirmatory Orders issued to Connecticut Yankee Atomic Power Company, Maine Yankee Atomic Power Company, and Yankee Atomic Electric Company (together the Yankee Companies).
The NRC previously issued Confirmatory Orders (ML12124A372, ML12124A373, and ML12124A374) to address the foreign ownership, control or domination (FOCD) requirements of Section 103d. of the Atomic Energy Act and 10 CFR 50.38. Prior to issuance of the Confirmatory Orders, the Yankee Companies requested an exemption from the FOCD requirements in 10 CFR 50.38 (ML11139A088). The NRC staff completed the review of the exemption request and, pursuant to 10 CFR 50.12, granted the request because it was authorized by law, presented no undue risk to public health and safety, was consistent with the common defense and security, and special circumstances were present.
The NRC has reviewed the Confirmatory Orders and exemption request and has determined to relax all conditions of the Confirmatory Orders in their entirety due to the granting of the Licensees exemption request.
