Closeout of MF4557 Crystal River desired to remove parts of Appendix B of their license, which contains the Environmental requirements, specifically for the reporting on Sea Turtles. Due to the environmental opinion provided by the National Marine Fisheries Service (NMFS), the staff wasnt sure how to proceed. An internal discussion with staff from RERB was held on 8/4 to discuss the possible path forward because there is no precedence for this type of action. On 8/5, a call was held with Crystal River to discuss this path forward, where the agreed path forward was to first have NRC/NMFS discussions, then a joint call with all three parties would be held.

The staffs discussion with NMFS resulted in NMFS stating that this is precedent setting for them too. After NMFS spoke with their lawyers, the NRC staff was told that approval for the removal of the reporting requirement is solely NRC discretion, which means the licensee will need to only submit a license amendment request. Accordingly, I told the licensee to simply submit a license amendment request during a telephone call. This action closes TAC MF4557 and the staff is waiting upon the license amendment request.
