Request for 10 CFR 51.95(b) Implementation Guidance During a recent conversation with the NRC staff, SHINE Medical Technologies, Inc. (SHINE) was informed of the need to provide the NRC with the required information in order to meet 10 CFR 51 .95, "Postconstruction environmental impact statements." Specifically, following issuance of a final environmental impact statement on the construction permit for the facility, SHINE would need to provide the NRC with information on matters that differ from the final environmental impact statement or that reflect significant new information concerning matters discussed in the final environmental impact statement in connection with the NRC issuing an operating license.

10 CFR 51.95(b), "Initial operating license stage," states the following, in part:

"In connection with the issuance of an operating license for a production or utilization facility, the NRC staff will prepare a supplement to the final environmental impact statement on the construction permit for that facility, which will update the prior environmental review. The supplement will only cover matters that differ from the final environmental impact statement or that reflect significant new information concerning matters discussed in the final environmental impact statement."

There is currently no regulatory implementation guidance (e.g., NUREG or Regulatory Guide) for licensees to use regarding the form, content, and process for a submittal that will satisfy the information needs requirements of 10 CFR 51.95(b). Therefore, SHINE requests the NRC provide the regulatory implementation guidance such that the necessary information required to satisfy the information needs requirements of 10 CFR 51.95(b) can be submitted by SHINE.
