Dear Mr. Pacilio:

This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI) to determine whether any additional individuals were involved with the two former senior reactor operators who were involved in criminal activities (aggravated vehicular hijacking). Based on the evidence developed during the investigation, we did not substantiate the issue. A summary of the OI report is enclosed.

We recognize that your staff performed its own evaluation of the information obtained by the local law enforcement agencies and that your evaluation did not develop any new issues.

SUMMARY

OF OFFICE OF INVESTIGATIONS REPORT On November 22, 2013, the Office of Investigations (OI) received information from the Woodridge Police Department and the DuPage County States Attorneys Office in regard to an interview held with a former senior reactor operator at the Exelon Generation Company Dresden Nuclear Power Station (Dresden) who was currently an inmate of the DuPage County system. During the interview the former operator mentioned another, current, Dresden senior reactor operator as being someone who had approached him initially with the idea of committing an armored car heist. Following a December 2, 2013, Allegation Review Board, OI gathered additional evidence to determine if the currently licensed operator had provided false statements to OI during his interview on June 8, 2012. Information was also provided to the licensee such that it could make a trustworthiness and reliability determination on the current operator.

The OI investigator interviewed the DuPage County inmate who provided information about the current Dresden operator. The investigator also interviewed the current senior reactor operator.

The current senior reactor operator discussed his interactions, his history, and his off-duty relationships with the two former senior reactor operators, but disavowed any involvement in their armored car heist plans. Although the investigator did not identify any vindictiveness on the part of the DuPage County inmate in naming the current senior reactor operator, neither was the investigator able to find any physical evidence or corroborating testimony connecting the current senior reactor operator to any criminal activity or to any planning or prior knowledge of the criminal activities. Therefore, the OI investigator did not substantiate that the current senior reactor operator provided false statements to OI.

The NRC evaluated the information gathered by OI and determined that there was insufficient evidence to substantiate that the current senior reactor operator was involved with the two former senior reactor operators plans.
