RE: St. Lucie Unit-2 Petition 2.206 Mr. Saporito, Please understand that the Petition Review Board's (PRB's) decision to reject the petition is a preliminary decision. While the Management Directive (8.11) does not provide for a formal written response with the basis for the preliminary decision, below I've provided a summary of the basis. MD 8.11 provides you to an opportunity to comment on the recommendation and you are welcome to provide any relevant additional information and support for your request.

Basis for Preliminary Decision to Reject to Petition:

The Petition raises issues that have already been the subject of NRC staff review and evaluation.

1) The NRC staff reviewed the 2007 Unit 2 SG replacement project, including the 10 CFR 50.59 evaluations used by FPL to decide if the changes to the plant required a license amendment.
2) The NRC staff reviewed and approved AMD 163 (ML12235A463; 9/24/12) the St. Lucie, Unit 2 Extended Power Uprate (EPU). This amendment provided evaluations of the SG replacements at the new power level.
3) The pressure boundary components of the replacement SGs, including the tubesheets, were designed in accordance with 10 CFR 50.
4) The plant has been operating acceptably for 7 years since the SGs were replaced in 2007. Tube wear has been successfully managed such that required tube integrity performance criteria have been met for all tubes.

Hello Lisa, Thank you for your recent voice mail regarding the PRB's action with respect to my 2.206 Enforcement Petition related to licensed operations at the St. Lucie Unit-2 nuclear plant.

Please provide the details of the PRB's recent action (decision) via email at your convenience.

Additionally, I request an additional opportunity to redress the NRC PRB regarding this matter- after I have had an opportunity to review the PRB's written decision. Once my review is completed, we can establish an agreeable date and time for the 2nd meeting via conference call.
