Dear Mr. Pollock:

The U.S. Nuclear Regulatory Commission (NRC) staff has considered a request from the Nuclear Energy Institute (NEI), on behalf of the nuclear industry to endorse the document entitled, Hardened Containment Venting System (HCVS) Phase 1 Overall Integrated Plan Template (EA-13-109) Rev 0 (Agencywide Documents Access and Management Systems (ADAMS) Accession Nos. ML14120A288 and ML14120A281).

The purpose of this template is to assist Boiling Water Reactor (BWR), Mark I and Mark II licensees, and is to be used in conjunction with NEI 13-02, Industry Guidance for Compliance with Order EA-13-109 (ADAMS Accession No. ML13316A853) in meeting the requirements of Order EA-13-109, Order Modifying Licenses With Regard To Reliable Hardened Containment Vents Capable of Performing under Severe Accident Conditions (ADAMS Accession No. ML13130A067). This template also provides references to white papers on selected subjects and frequently asked questions (FAQs) which were developed as part of preparing the guidance provided in this template. White papers, on selected subject areas provide additional guidance and/or describe alternate methods for complying with the requirements of Order EA-13-109 which have been reviewed and endorsed by the NRC staff. The FAQs provide further clarification and/or interpretation of guidance provided in selected areas in interim staff guidance (ISG) JLD-ISG-2013-02, NEI 13-02, and the Overall Integrated Plan (OIP) template. Since the issuance of the ISG in November 2013, the NRC staff has held several public meetings and interacted with your staff and external stakeholders during the development of this template.

The NRC staff agrees that this document provides an acceptable description and guidance in preparation of the OIP for complying with Order EA-13-109 using methods described in NEI 13-02 and endorsed by the NRC in JLD-ISG-2013-02 Interim Staff Guidance JLD-ISG-2013-02, "Compliance with Order EA-13-109, Order Modifying Licenses with Regard to Reliable Hardened Containment Vents Capable of Operation Under Severe Accident Conditions. Rev. 0 (ADAMS Accession No. ML13304B836). The NRC staff will evaluate a licensees application of the guidance in its development of the final safety evaluation documenting compliance with NRC Order EA-13-109.

Individual licensees should inform the NRC of their plans to abide by this guidance and implementation approach, and their plans to address potential plant specific issues associated with implementing the order requirements. Licensees are strongly encouraged to follow the template in conjunction with NEI 13-02 and JLD-ISG-2013-02 in order to

J. Pollock satisfy the order requirements related to submittal of the OIP, improve the efficiency of the NRCs review and to minimize further requests for information. If a licensee deviates from the technical guidance referenced in the template, the licensee should justify the deviations and provide information that demonstrates how the associated requirements in NRC Order EA-13-109 will be met during an extended loss of alternating current power.
