Dear Judge Hawkens:
On May 5, 2014, staff counsel filed a Joint Proposed Schedule per your request made during the April 24, 2014 pre-hearing telephone conference in this matter. In that filing, the entire agreement between counsel for the parties was not made clear. In addition, due to a misreading of a witness schedule, the agreed upon hearing date requires a change.
Counsel have agreed that the applicants will not be required to make initial disclosures. We have also agreed that the staff will not be required to update the hearing file. However, if new and significant information related to the matters in litigation becomes known to any party it should be disclosed to the other parties in a timely manner.
Finally, the parties and counsel have agreed to a hearing date during the week of August 11, 2014, preferably August 12 - 13, due to conflicts later in the week.
