UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 The Honorable Barbara Boxer Chairman, Committee on Environment and Public Works United States Senate Washington, DC 20510

Dear Madam Chairman:

April 25, 2014 This letter conveys documents responsive to your March 5, 2014, questions submitted for the record of the Committee's January 30, 2014, hearing with the Commission. Specifically, a secure USB drive is enclosed that provides:

a) A copy of the Differing Professional Opinion related to Diablo Canyon Power Plant prepared by NRC's former Resident Inspector at that facility (question #2 for the hearing record) b) Files of documents prepared by or in the possession of the Nuclear Regulatory Commission (NRC) related to the October 2011 license amendment request to alter the seismic licensing basis for Diablo Canyon (question #3 for the hearing record).

With regard to the Differing Professional Opinion (DPO) submittal, the DPO program supports openness and transparency once its process is complete. Because it is still within the agency's process, the requested DPO is considered pre-decisional and, as such, is marked "not for public disclosure." The documents related to the October 2011 license amendment request are also marked "not for public disclosure." In the way of a reminder, we respectfully ask that these handling instructions be honored.

The remaining responses to questions submitted for this hearing's record will be provided under separate cover.

Please feel free to contact me at (301) 415-1776 if you have questions or need more information.

Sincerely, L

Amy Powell, Acting Director Office of Congressional Affairs

Enclosure:

As stated cc: Senator David Vitter
