TURKEY POINT NUCLEAR GENERATING UNIT NOS. 3 AND 4-WITHDRAWAL OF AMENDMENT REQUEST (TAC NOS. MF0084 AND MF0085)

Dear Mr. Nazar:

By letter dated October 30, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12307A019), Florida Power & Light Company (the licensee) applied for amendments to the Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point 3 and 4) Technical Specifications (TSs), which are incorporated as Appendix A to Renewed Facility Operating License Nos. DPR-31 and DPR-41 for Turkey Point 3 and 4, respecively. The proposed amendments would have revised TS 3/4.5.2, "ECCS [Emergency core cooling system] Subsystems-Tavg Greater Than or Equal To 350 oF [degrees Fahrenheit]," and TS 3/4.8.1, "A. C. [Alternating Current] Sources." The proposed amendments were also intended to address nonconservative TSs.

By electronic mail dated November 7, 2013 (ADAMS Accession No. ML14013A005), the U.S. Nuclear Reguatory Commission (NRC) staff requested additional information regarding the licensee's application dated October 30, 2012. As a result of subsequent discussions with the NRC staff regarding this request and proposed TS changes, the licensee requested to withdraw its application by letter dated March 26,2014 (ADAMS Accession No. ML14104B433). In its letter, the licensee stated that it will restructure the request and proposed changes and resubmit a revised application at a later date. The licensee also stated in its letter that in the interim, until the nonconservative TSs are revised, compensatory admininstrative controls will remain in place.

The NRC permits the licensee to withdraw its application dated October 30, 2012. As a result, NRC staff ceased work activities on the requested amendments, which were tracked by Technical Assignment Control Nos. MF0084 and MF0085.

The NRC filed the enclosed Notice of Withdrawal of Application for Amendments to Facility Operating Licenses with the Office of the Federal Register for publication.

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) received a request from Florida Power & Light Company (the licensee) to withdraw its application dated October 30, 2012, for proposed amendments to Renewed Facility Operating License Nos. DPR-31 and DPR-41. The proposed amendments would have revised Technical Specification (TS) 3/4.5.2, "ECCS

[Emergency core cooling system] Subsystems-Tavg Greater Than or Equal To 350°F [degrees Fahrenheit]," and TS 3/4.8.1, "A. C. [Alternating Current] Sources." The NRC permitted the licensee to withdraw the application.

SUPPLEMENTARY INFORMATION:

The NRC permitted Florida Power & Light Company to withdraw its application dated October 30, 2012 (ADAMS Accession No. ML12307A019), for proposed amendments to Renewed Facility Operating License Nos. DPR-31 and DPR-41 for the Turkey Point Nuclear Generating Unit Nos. 3 and 4, respectively, located in Miami-Dade County, Florida. The proposed amendments would have revised TS 3/4.5.2, "ECCS Subsystems-Tavg Greater Than or Equal To 350°F," and TS 3/4.8.1, "A.C. Sources."

The NRC issued a Notice of Consideration of Issuance of Amendments to Facility Operating Licenses published in the Federal Register (FR) on February 19, 2013 (78 FR 11692). However, by letter dated March 26, 2014 (ADAMS Accession No. ML141048433), the licensee requested to withdraw the proposed amendments.
