ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about February 11, 2014, to NextEra Energy Duane Arnold, LLC (NextEra) for a violation associated with a White Significance Determination Process finding identified during an inspection of the Duane Arnold Energy Center. The White finding, an issue of low to moderate safety significance, will require additional U.S. Nuclear Regulatory Commission (NRC) inspections. It involves the failure of Duane Arnold personnel to perform an immediate operability determination in accordance with NextEras procedures on June 21, 2013, when a reactor core isolation cooling (RCIC) system turbine speed indicator in the main control room was found degraded. Specifically, Duane Arnold personnel failed to consider the degraded speed indications impact on RCIC operability. As a result, RCIC inoperability was not discovered until August 22, 2013, when the RCIC turbine tripped on overspeed during startup for post-maintenance surveillance testing.
A Notice of Violation is included based on NextEras failure to meet Technical Specification 3.5.3, RCIC System, which requires the RCIC system shall be operable when operating in MODES 1, 2 or 3 with reactor steam dome pressure greater than 150 psig. Specifically, from June 21, 2013, to August 24, 2013, the RCIC system was inoperable for a period greater than the Technical Specification allowed outage time of 14 days. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.
In response to the preliminary determination letter, NextEra attended a Regulatory Conference on January 8, 2014, and provided information on the risk characterization of the finding and corrective actions. After reviewing the information developed during the inspection, and the information provided by NextEra, the staff concluded that the inspection finding is appropriately characterized as White.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
