INDUSTRY GUIDELINE FOR THE ITAAC CLOSURE PROCESS UNDER 10 CFR PART 52
Dear Mr. Bell:
The Nuclear Regulatory Commission (NRC) has completed its review of Nuclear Energy Institute (NEI) 08-01, Revision 5, Industry Guideline for the ITAAC Closure Process Under 10 CFR Part 52, which was submitted to the NRC on July 18, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13233A220). NEI 08-01 provides guidance for the inspections, tests, analyses and acceptance criteria (ITAAC) program for new nuclear plants licensed under Title 10 of the Code of Federal Regulations (10 CFR),
Part 52.
The staff provided comments on NEI 08-01, Revision 5, in a February 12, 2014, email (ADAMS Accession No. ML14056A453). At a public meeting on February 27, 2014 (ADAMS Accession No. ML14069A049), the staff received feedback that its comments were either:
- 1. editorial comments that do not need to be addressed for the NRC to endorse NEI 08-01, Revision 5, in an update to Regulatory Guide (RG) 1.215, Guidance for ITAAC Closure Under 10 CFR Part 52;
- 2. related to ITAAC Closure Notification (ICN) examples that had already been reviewed and accepted by the staff; or
- 3. not consistent with NRC positions stated in earlier public meetings.
Based on that public meeting feedback, the staff committed to reassess its comments and publically document the results of that reassessment.
The staff determined that some comments were editorial in nature or did not otherwise need to be addressed in order for the staff to endorse NEI 08-01, Revision 5. The staff encourages licensees and NEI to consider these comments when developing ICNs and when revising NEI 08-01 in the future. As part of its reassessment, the staff determined that although some comments would not prevent NRC endorsement of NEI 08-01, Revision 5, those comments may be discussed in the staffs next revision to RG 1.215. In some cases, however, the staff determined that it would be unable to endorse certain portions of NEI 08-01, Revision 5, unless the comments are resolved. The enclosure to this letter provides the staffs original comments and an explanation of the reassessment for each item.
