Dear Mr. Stafford:

The U.S. Nuclear Regulatory Commission (NRC) received your letter dated January 6, 2014. In your letter, the New York State Department of State (NYSDOS) indicated that it will provide responses to the NRC's six questions related to the New York State coastal zone consistency review for Indian Point Nuclear Generating Unit Nos. 2 and 3 (Indian Point Units 2 and 3). NRC sent these six questions to NYSDOS as part of the consultation process required by Title 15 of the Code of Federal Regulations (CFR) Sectton 930.51 (e). The regulations in 15 CFR 930.51 require. for the renewal or major amendment of a Federal license or permit, that a revtew be conducted of the consistency of the proposed action with the State's coastal management program (CMP) The regulations further indicate that the renewal of a Federal license or permit for an activity that has previously been reviewed for consistency with the State's CMP does not require a subsequent consistency determination, unless the proposed action will cause an effect on any coastal use or resource substantially different than those previously reviewed by the State agency.

The NRC staff appreciates your initial response and looks forward to reviewing NYSDOS's responses to the NRC's questions related to the New York State coastal zone consistency review for lndtan Point Unit 2 and 3. Responses by NYSDOS wtll be helpful to the NRC staff in our review of the license renewal application for Indian Point Units 2 and.3.
