In accordance with NRR Office Instruction LIC-102, Relief Request Reviews, ADAMS ML091380595, on December 11, 2013, the NRR staff provided verbal authorization for Indian Point 3 Relief Request IP3-008 regarding a non-Code repair to the service water system piping. The authorization was provided using the attached script. As indicated, the staff will follow up with a written safety evaluation within 150 days.

VERBAL AUTHORIZATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION FOR RELIEF REQUEST IP3-008 ALTERNATE REPAIR OF SERVICE WATER PIPE INDIAN POINT NUCLEAR GENERATING UNIT NO. 3 ENTERGY NUCLEAR OPERATIONS, INC.

DOCKET NUMBER 50-286 DECEMBER 11, 2013 Technical Evaluation read by John Huang, Acting Chief of the Component Performance, Non-Destructive Examination, and Testing Branch, Office of Nuclear Reactor Regulation, By application dated November 20, 2013, supplemented by letters dated December 6 and 9, 2013, Entergy Nuclear Operations, Inc., the licensee, requested relief from certain requirements of American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code),

Section XI, IWA-4422.1 regarding the repair of service water system piping at Indian Point Unit No. 3. The licensee proposed an alternative to the monitoring requirements of ASME Code Case N-513-3 at the defect areas of the degraded service water piping as documented in Relief Request Number IP3-008. The duration of this proposed alternative is limited until the next refueling outage which is scheduled for spring 2015. At that time, the licensee will permanently repair/replace the subject pipe in accordance with the ASME Code,Section XI.

On the basis of information submitted, the NRC staff has determined that the proposed alternative will provide reasonable assurance that the structural integrity and leak tightness of the repaired piping will be maintained until the next refueling outage in spring 2015. The staff finds that complying with the specified ASME Code requirement would result in hardship or unusual difficulty without a compensating increase in the level of quality and safety.

Accordingly, the staff concludes that the licensee has adequately addressed all of the regulatory requirements set forth in 10 CFR 50.55a(a)(3)(ii).

As Chief of the Plant Licensing Branch I-1, Office of Nuclear Reactor Regulation, I concur with the Component Performance, Non-Destructive Examination, and Testing Branchs conclusions.

Effective December 11, 2013, the NRC staff authorizes the proposed alternative at Indian Point for the service water pipe repair described in Relief Request IP3-008 up to the next refueling outage which is scheduled for spring 2015.

All other requirements of ASME Code,Section XI, for which relief was not specifically requested and authorized by the NRC staff remain applicable, including the third party review by the Authorized Nuclear In-service Inspector. This verbal authorization does not preclude the NRC staff from asking additional clarification questions regarding IP3-008 while preparing the subsequent written safety evaluation. The NRC staff plans to issue the written safety evaluation within 150 days in accordance with the Office of Nuclear Reactor Regulation standards.
