On November 13, 2013, New York State (New York) filed a response to the NRC Staffs 21st Status Report concerning certain information regarding recent regulatory events.1 On November 14, 2013, Entergy filed a reply and requested that the Board require New York to clarify the purpose of paragraph 2 of New Yorks response.2 The Board declines to require New York to clarify, but notes that the information in the paragraph at issue was not offered as an exhibit, has not been received in evidence, and, accordingly, will not be considered by the Board in resolving the Track 1 Contentions addressed in our Partial Initial Decision, dated November 27, 2013.
