On November 25, 2013, the State of New York (New York) filed a motion seeking leave to submit a recently-issued ruling by the New York State Public Service Commission as an exhibit in connection with contention NYS-37.1 The Public Service Commission ruling (PSC Order) addresses energy alternatives in the form of energy efficiency, demand reduction, and combined heat and power programs.2 New York argues that the PSC Order is relevant to the NRC Staffs Environmental Impact Statement (EIS) Chapter 8s examination of the no-action alternative and alternative energy sources.3 In its Section 2.323 Certification, New York stated 1

that the NRC Staff and Entergy object to the introduction of the November 4, 2013, NYS PSC Order as an exhibit in this proceeding.4 The Board declines to admit the PSC Order as an exhibit. In NYS-37, the question before the Board is whether the NRC Staff met its NEPA and 10 C.F.R. § 51.91(a)(1) obligation by taking a hard look at the environmental impact of the no-action alternative.

Here, the NRC Staff has not, and could not, consider the PSC Order in drafting its FSEIS.

However, pursuant to 10 C.F.R. § 51.92(a)(2), the Staff has an obligation to prepare a supplement to its EIS if there is new and significant information relevant to environmental concerns and bearing on the proposed action or its impacts.

We believe that it would be premature for the Board to consider the PSC Order before the NRC Staff has had the opportunity to review its impact and determine whether to supplement the existing FSEIS. Accordingly, the NRC Staff shall report to the Board within 45 days of the date of this order whether it will supplement the FSEIS pursuant to Section 51.92(a)(2) and, if so, shall provide a realistic estimate of when any such draft SEIS will issue.

We further direct New York to delay the filing of any new contention based on the PSC Order or the information contained therein until further Order of this Board which will await the submission of the Staffs report.

NYS-37, which concerns the adequacy of the no-action alternative analysis in the NRC Staffs FSEIS, has been resolved by our partial initial decision issued today. Relative to future action by the NRC Staff regarding the PSC Order, if New York concludes that an adequate hard look at the no-action alternative has not been taken once the Staff has had the opportunity to consider the impact of the the PSC Order, it would have the option of filing a new contention challenging the FSEIS, that would then be evaluated by the Board 4

solely under the contention admissibility standards of 10 C.F.R. § 2.309(c), without regard to the standards of 10 C.F.R. § 2.326 that would govern any attempt to reopen the now-closed evidentiary record regarding NYS-37. Such a submission by New York would be a newly proposed contention, not a continuation of NYS-37.

If an admissible contention arising from the PSC Order is admitted, it would be the Boards intent to establish an expedited schedule so that it could be resolved with the pending Track 2 Contentions.
