RESPONSE TO YOUR CONCERNS REGARDING THE CONDUCT OF THE HUMBOLDT BAY LICENSE TERMINATION PLAN PUBLIC MEETING AND THE AVAILABILITY OF THE HUMBOLDT BAY LICENSE TERMINATION PLAN

Dear Mr. Manetas:

I am responding to your October 25, 2013, E-Mail to Chairman MacFarlane regarding the Humboldt Bay Nuclear Reactor. I appreciate your interest in public involvement in the Nuclear Regulatory Commissions (NRCs) decommissioning process and understand your concerns regarding the availability of the Humboldt Bay License Termination Plan (LTP) on the NRCs web site.

Public involvement in the NRCs activities is a cornerstone of strong, fair regulation of the nuclear industry. The NRC recognizes the publics interest in the proper regulation of nuclear activities and provides opportunities for citizens to make their opinions known. The NRC seeks to elicit public involvement early in the regulatory process so that safety concerns that may affect a community can be resolved in a timely and practical manner. This process is considered vital to assuring the public that the NRC is making sound, balanced decisions about nuclear safety. Consistent with this policy, the NRC held the public meeting on August 20, 2013, to discuss the submittal of the Humboldt Bay LTP and the NRCs review process. That meeting was noticed consistent with our standard practice. Specifically, notice of the meeting was provided on the NRCs web site, in the Federal Register, and in the local newspaper. The licensee also agreed to mention the meeting at public interactions they held in the months prior to the meeting. We also understand that the meeting was mentioned on local radio as a result of the newspaper notice. Also, public outreach has been conducted by the licensee throughout the decommissioning process, including through the efforts of the Humboldt Bay Citizens Advisory Board.

I would like to apologize for any difficulty you had locating the LTP on the NRCs web site. I appreciate that it can sometimes be difficult to locate a specific document in the NRCs Agencywide Documents Access and Management System (ADAMS). However, I would like to point out that the Accession Number, or ADAMS location number, for the Humboldt Bay LTP was included in the meeting notices in both the Federal Register and local newspaper. In addition, the Humboldt Bay Project Manager, John Hickman, mentioned at the public meeting that he had copies of the LTP on a compact disc with him for anyone who would like one.
