Board's Referred Ruling in LBP-13-1 (Feb. 6, 2013)
The Commission approved a Memorandum and Order responding to the Boards referred ruling in LBP-13-1. The order takes review of the referred ruling, finds that the Board erred in interpreting the purpose of the Severe Accident Mitigation Alternatives-analysis exception in 10 C.F.R. § 51.53(c)(3)(ii)(L), affirms the Boards denial of Natural Resources Defense Councils waiver petition, and directs the Staff to review and discuss in its final supplemental environmental impact statement any new Severe Accident Mitigation Alternatives-related information associated with the Limerick license renewal application.
(Subsequently, on October 31, 2013, the Secretary signed the Memorandum and Order.)
