NRC STAFFS RESPONSE TO THE ATOMIC SAFETY AND LICENSING BOARDS ORDER OF OCTOBER 8, 2013 In accordance with the Atomic Safety and Licensing Boards (Board) Order (Directing Parties to Review Exhibit List) (Order), issued on October 8, 2013, 1 the NRC Staff (Staff) herewith provides its suggested revisions to the Boards proposed Official Exhibit List for Track One Contentions (Exhibit List).
The Staffs suggested revisions, set forth in the Attachment hereto, 2 consist of (a) proposed exhibits that were omitted in the Boards proposed Exhibit List, 3 (b) proposed revisions to the titles of exhibits listed by the Board, and/or (c) proposed revisions to the list of applicable contentions to which each exhibit pertains. In accordance with the Boards direction that an explanation be provided for each proposed revision, the Staffs suggested revisions to 1
Pursuant to the Commissions Corrected Notice of October 17, 2013, the Boards deadline of October 21, 2013, for the parties filing of proposed revisions to the Exhibit List was deferred by eight days, until October 29, 2013.
2 The Attachment hereto utilizes the format of the Boards proposed exhibit list, with modifications to the titles of two columns: (Date Stricken or Excluded, and Other/Comment) (emphasis added).
3 Principal among these are the Staffs Safety Evaluation Report (Exhibit NYS00326A-F) and the ACRS letter (Exhibit NYS000325) related to license renewal of IP2/IP3, which the Staff is required to introduce into evidence in this proceeding pursuant to 10 C.F.R. § 2.337(g).
the Boards Exhibit List are identified in redline/strikeout and the reason for each suggested revision is provided in column nine of the Attachment hereto (Other/ Comment).
For the reasons stated in the Attachment hereto, the Staff respectfully requests that the proposed revisions identified in that Attachment be incorporated in the Boards Official Exhibit List for Track One Contentions.
