October 9, 2013 MEMORANDUM TO:
SSD Case File 13-22 First Alert/BRK Brands, Inc.
Sealed Source and Device Registration NR-88282-D-801-E FROM:
John Jankovich /RA/
Licensing Branch, FSME/MSSA Tomas Herrera /RA/
Licensing Branch, FSME/MSSA
SUBJECT:
No Checklist or Safety Evaluation Performed By letter dated May 1, 2013, (ML13127A441) BRK, Inc. requested the inactivation of their sealed source registration certificate NR-0167-D-101-E.
Based on the information provided in the referenced letter above the registration certificate NR-1081-S-101-S was incativatedand inactive registration certificate NR-8282-D-801-E was issued to supercede it.
Production of the smoke detector did not cease. The inactivation was based on the the changes in the regulatory requirements in 10 CFR 3.14 and 10 CFR 32.26, issued on July 25, 2012, removing registration requirements for smoke detectors containing 1.0
µCi or less of Am-241. Consequently, the questions associated with inactivation, as listed in the applicable guidance document, NUREG-1556, Vol. 3, Rev. 1, Section 13.4 were not asked as not being applicable (i.e., the product was not discontinued).
For the same reason, no safety evaluation or the preparation of a checklist for sealed sources and devices was necessary.
