Dear Mr. Fertel:
I am writing to you in response to your October 3, 2013 letter, and your subsequent letter dated October 4, 2013, both related to the U.S. Nuclear Regulatory Commission (NRC) providing fingerprints for access authorization decisions at NRC-licensed facilities. The NRC recognizes the importance of the criminal history background check process. The administration of requests for criminal history background checks is funded by processing fees.
The NRC is authorized, pursuant to 42 U.S.C. § 5852(c), to retain and use those receipts, which are available until expended. The reimbursements are used to pay the Department of Justice for the background checks and to offset NRCs costs in administering this program.
Accordingly, the NRC expects to continue this activity without interruption through any foreseeable lapse in appropriation.
