Dear Dr. Macfarlane:

DISTRICT OFFICE 659 Tuxedo Blvd St. Louis, MO 63119 Tele: 314-968-0124 On November 1, 2012, former State Representative Jeanette Oxford wrote to you concerning an October 21, 2003 event at the Ameren nuclear reactor in Callaway County, Missouri. This event has purportedly been investigated by the NRC on numerous occasions, yet Lawrence Criscione, a former NRC Senior Reactor Operator at Callaway Plant, claims that "despite over a thousand of hours spent investigating the incident, the NRC still either cannot or will not answer basic questions concerning the incident." Mr. Criscione's concern stems from his belief that the NRC was aware that their licensed operators at the Callaway Plant were less than forthcoming, that the NRC has not been able to definitively disprove the operators' claims and therefore, the issue has been ignored.

Like Representative Oxford, I am troubled by the suggestion that mistakes have been concealed from the NRC, leaving the issue unresolved.

Representative Oxford's eight year tenure in the Missouri House of Representatives ended in January because of term limits. I am writing to follow up on her letter to you.

In her letter, Rep. Oxford requested that the NRC provide the following information:

1.

An assessment as to whether or not the information contained in "CAR 200702606, Action 5" is accurate.

2.

An assessment as to when the operators at Callaway Plant first recognized the reactor was no longer critical on October 21, 2003.

3.

An assessment as to why the operators allowed the reactor to operate in the source range for over 45 minutes with its control rods still at their critical rod heights and with no Source Range Nuclear Instruments energized.

4.

An assessment as to why the Reactor Operator spent 30 minutes raising letdown flow from 75 to 120 gpm instead of taking 10 minutes to insert the control banks.

5.

An assessment as to why NRC licensed reactor operators were available to remove an intake pump from service and to place cooling tower blowdown in service yet were not available to insert the control banks.

In February, the International Nuclear Safety Journal (INSJ) published a paper written by Mr. Criscione regarding the October 21, 2003 inadvertent passive reactor shutdown and the responses by Ameren and the NRC.

Criscione felt answers to Rep. Oxford repeated requests should have been readily available. I request that your office provide me the answers to the items above, which were sought by Representative Oxford. Would your agency also please review Mr.

Criscione's paper and convey to me the accuracy of Mr. Criscione's assertions or where he erred in his analysis?
